Terms and Conditions for Authors

Before submitting any articles to ToothAid School website, please read the following terms and conditions carefully. When submitting articles to be published on ToothAid School website, you are required to agree to the terms laid out below.

The Terms and Conditions for Authors may be changed or updated at any time and they will apply to all articles. This includes the articles that you have already submitted to us, and any subsequent articles. The latest version of the Terms and Conditions for Authors are laid out below. If you do not agree to any of these terms, please do not submit articles to ToothAid School.

Terms

These terms and conditions are made by and between ToothAid School (Publisher) and the registered author (Author). The published version of the Author’s work is referred to as Article.

1. Independent Individual Status

When Author submits articles to Publisher, Author is doing so as an entirely independent individual, not as an employee of Publisher. This means Author is entirely responsible for obtaining and paying for any and all of Author’s own equipment and facilities to write and submit articles to Publisher. Author agrees to not entitled to, and not expect, any wages, compensation, commission, or remuneration of any kind for any of the content, be it written, pictorial or otherwise submitted. By submitting articles to Publisher, Author understands that Author is not eligible for any employee benefit plans or schemes, remuneration, commission or payments either now, or at any time in the future, as a result of the submission of articles and Publisher’s subsequent use of them.

2. License of Rights

When Author submits Article to Publisher, Author remains the owner of the copyright to all Author’s content, hence Author can post it anywhere else Author wishes. However, by submitting any content to Publisher (including text, videos, photographs, audio and any other materials), Author is granting, assigning, and transfering Publisher a sole, worldwide, royalty-free, irrevocable, perpetual license to exercise all rights under copyright law with respect to such content.

The sole licence mentioned in the previous paragraph encompasses the right for the Publisher:
a. to reproduce (or authorise others to do so) the Article, in whole or in part, and to communicate the Article to the public (or authorise others to do) in print and/or digital form, whether or not in combination with the works of others, for example the making available to the public via internet or any other network, as part of a database, on-line or off-line, for use by third parties;
b. to translate the Article (or authorise others to do) into other languages and to communicate the translation of the Article to the public (or authorise others to do);
c. to create adaptations, summaries or extracts of the Article or other derivative works based on the Article and exercise all of the rights in such adaptations, summaries, extracts and derivative works;
d. to include the Article, whether in translation or as adaptation or summary, in whole or in part in a computerised database and to make this database available to third parties;
e. to include the Article, in whole or in part, whether in translation or as adaptation or summary, in a reader or compilation;
f. to reproduce the Article by means of reprography (or authorise others to do so), notwithstanding the limitations in the law.

Author grants, assigns, and transfers to Publisher the full and exclusive right to: publish, reproduce, publicly distribute, transmit and display, and otherwise use the articles worldwide, including all revisions thereof, in ToothAid School, in all media now known or later developed; license publication of the articles to others to include in any print or digital media; and register and hold the copyright to the articles in Publisher’s name as publisher, in its sole discretion, considers necessary and appropriate. Author cannot submit duplicate articles to other publications and cannot submit articles to Publisher that have already been published in other publications.

3. Rights retained by Author

The Author retains among others, the following rights with respect to the Article:

Educational or instructional use

To reproduce the Article, in whole or in part, and to communicate it to the public, whether in print and/or digital form, whether as part of a reader or a compilation, for use in education or research within the Author’s own institution, provided this use pursues no direct or indirect economic or commercial advantage;

Dissemination

To grant the Institution the authorisation to upload the Article onto the Institution’s closed network (e.g., an intranet system); and to grant the Institution the authorisation to upload, after an embargo period of a maximum of six (6) months from the date in which the Article is published in Publisher, unless it is clear that the Publisher agrees to a shorter term, the Article to the Institution’s publicly accessible institutional repository, provided that this is not for direct or indirect economic or commercial advantage and that a link is inserted which is directed to the Article on the Publisher’s website.

Preservation

To grant to the Institution the authorisation to reproduce the Article for the purpose of preventing it from deteriorating, or if the original is currently in an obsolete format or the technology required to use the original is unavailable, for the purpose of ensuring that the Article continues to be available for education and research purposes;

Future reuse

To reuse whole or part of the Article in a dissertation, compilation or other work, provided that such use pursues no direct or indirect economic or commercial advantage. For any commercial reuse of the Article, the Author undertakes to obtain the Publisher’s consent.

Personal use

To present the Article at a meeting or conference and to hand out copies of the Article to the delegates attending the meeting provided that all such use pursues no direct or indirect economic or commercial advantage; To post it to own social media platform in digital format.

For every form of (re)use of the Article as described in the above paragraphs, the Author or the Publisher undertakes to always include the complete source (at least the Author’s name, the title of the Publication, and the name of the Publisher), unless this is impossible.

4. Copyright

Author warrants that Author is vested with sole ownership and with the power to convey all rights that are granted and assigned in these terms; the copyright has not previously been assigned nor the articles published elsewhere; the articles do not infringe any valid copyright or other proprietary right of any other person; the articles contain no libelous, defamatory or other unlawful material, nor do they violate any proprietary rights nor invade the privacy rights or infringe the publicity rights of any third party; and if the articles include any copyrighted material not in the public domain, Author will obtain the reprint permissions and provide them to Publisher on or about the time the articles are delivered to Publisher.

5. Edits/Rewrites

Publisher is authorized to edit the articles for style, usage, and felicity; provided, however, that Publisher shall not be free to make substantive changes in the articles without the express approval of Author. If Publisher determines that any article is not suitable for publication, Author retains all rights to the article.

6. Hold Harmless Statement

Author agrees to hold Publisher, its employees and agents harmless from any claim, suit or proceeding based on the grounds that the articles infringe any valid copyright or other proprietary right of any other person; contain libelous, defamatory or other unlawful material; invade the privacy rights or infringe the publicity rights of any other person; and agrees to indemnify Publisher, its employees and agents for reasonable expenses incurred in defending, settling, or otherwise responding to such claims.

7. Monetization

Publisher reserves the right to add adverts or links to Article which may or may not include affiliate links from which Publisher may stand to benefit financially or otherwise. Publisher reserves the right to place advertising upon Article, in the sidebar, or any other visible area near to it. By submitting Article to Publisher for publication, Author is stating that Author understands and accepts that Publisher is financially supported in part by the generation of revenue from marketing and advertising and that this income is in part generated by adding links, including affiliate links, and advertisements to Article and the areas shown around Article. The placing, choice, content or any other feature of advertisements or affiliate links on or around Article is non-negotiable.

8. Miscellaneous

As full compensation for the Services to be provided by Author, Publisher agrees to provide Author author recognition as follows: Name, Affiliation, Company Name, Professional Biography, Profile Photo and a direct link back to the corresponding ToothAid School author profile. It is the Author’s obligation to provide the above details to Publisher. By applying to become an approved Author for Publisher, even before any Article has been submitted or published, Author is agreeing that if Publisher is legally required to disclose information about Author (including IP address, location, name, user name or any other information, excluding password), Author has given Publisher permission to do so, without the need to provide any notice or notification to Author.

Publisher may notify Author about Publisher article submission system at any time, including any changes to these terms and conditions, by e-mail, however Publisher is not obliged to do so. The most up-to-date version of these terms and conditions is available to view on Publisher website. These Terms and Conditions for Author, along with Publisher Privacy Policy as provided on the website, make up the entire agreement between Author and Publisher and cannot be changed unless Publisher agrees to it in writing.
